This is a suit brought against the collector of internal revenue to recover the sum of $8,644.35 paid by the plaintiff to the United States as income and excess profits taxes for the year 1917 and now claimed to have been excessive, erroneous, and illegal, and paid under duress. By written stipulation a jury was waived and all matters of law and fact submitted to the court.
