The collision, the subject of this litigation, occurred on the 22d of March, 1924, about 10 o'clock a. m., on the southern branch of the Elizabeth river, at a point where the railway line of appellant, the Norfolk & Portsmouth Belt Line Railway Company, spans the Elizabeth river with its drawbridge, required to be maintained, with suitable draws, to admit of the free navigation of the river.
