This is a statutory action by the Holly Sugar Corporation against the board of county commissioners of Mesa county, Colo., and the Colorado tax commission, to recover $4,598.35, the amount of an alleged erroneous and illegal tax collected by the treasurer of Mesa county, under protest, upon an alleged erroneous and illegal assessment for the year 1924.
