On October 20, 1923, the Red Star Towing & Transportation Company received an order from the libelant, Empire Brick & Supply Company, to transfer its scow Empire Brick No. 14, light, from Flushing creek to Cornell stakeboat, which was at anchor in the North River, off Weehawken, N. J. There was a conflict in the testimony, but I find the facts to be as follows:
