This action is brought by John G. Ordway, Samuel G. Ordway, and Lucius P. Ordway, Jr., as trustees under a deed of trust dated January 16, 1917, against L. M. Wilcutts, collector of internal revenue, to recover income taxes for the years 1917, 1918, 1919, 1920, 1921, and 1923, amounting to $5,759.73, and alleged to have been erroneously assessed and collected.
