The plaintiff, owner by assignment of patent, No. 1,071,364, charges the defendant, Mesta Machine Company, with infringement of claim 1 of said patent, issued August 26, 1913, to James Ramsey Speer and William R. Forster, assignors of the plaintiff. The title of the patent is an "alloy of iron"; the claim and issue being for "a new article of manufacture," an "alloy of iron" containing certain elements.
