Plaintiffs in error (hereinafter called defendants) were convicted upon two counts of an indictment charging them and others with conspiracy to violate the provisions of the National Prohibition Act (Comp. St. Ann. Supp. 1923, § 10138¼ et seq.), by unlawfully transporting and selling 1,400 cases of whisky for beverage purposes.
