The plaintiff in the main case is engaged in the production of theatrical shows. It insured the production, "The Passing Show of 1920," against fire with the defendant insurance company. This production was destroyed by fire, and, when the defendant refused or failed to pay the insurance under the terms of the policy, plaintiff determined to sue for the damages sustained through the fire loss.
