Guy, brought suit in the court below as plaintiff against the appellant, Norris Walls, as defendant, to recover damages alleged to have been sustained by plaintiff, by reason of the failure of defendant to properly carry out the terms of a contract entered into by the parties for the construction of a basement or cellar, under a certain dwelling house occupied by plaintiff.
