GILBERT, Circuit Judge.

The plaintiff in error was convicted under two counts of an information which charged him with maintaining a common nuisance and the unlawful possession of intoxicating liquors. He assigns error to the denial of his petition for the suppression of evidence obtained under a search warrant issued by a United States commissioner, and contends that it was illegally obtained, first, because the search warrant did not issue in the name of the President...
