This cause is before me on petition for review filed by A. F. Scruggs and S. R. Scale, creditors, whose debts are secured by two mortgages, complaining of an order of the referee invalidating the mortgages as to the trustee. The mortgages were executed in June and July, 1923, and were legally lodged for record November 19, 1924.
