This is a habeas corpus proceeding. The material facts are as follows: On October 28, 1924, the relator, Morris Manchbach, appeared before me, charged, in an information, with two violations of the National Prohibition Act, illegal possession and illegal transportation of intoxicating liquor. No charge, or allegation indicating same, was in this information that defendant was anything but a first offender.
