Plaintiff in error, who was the defendant below, was heretofore indicted and convicted in the Western division of the Eastern district of Arkansas, on two counts of an indictment which charged him with the making of certain false entries in the books of the Citizens' National Bank of Hot Springs, Ark., and with the embezzlement of certain moneys from this bank. Upon his conviction on the former trial he sued out a writ of error to this court...
