The plaintiff is the receiver, appointed by the Comptroller of the Currency, of the Second National Bank of Elkton, Cecil county, Md. The defendants are the widow, heirs at law, and executor of William T. Warburton, late of that county, deceased, and some time president of the bank. He died very shortly before the institution of these proceedings, leaving a will by which he appointed a son, the defendant Henry A. Warburton, as executor, and empowered...
