MR. JUSTICE SHIRAS, after stating the case, delivered the opinion of the court.

As both the District Court and the Circuit Court, though for somewhat different reasons, found the Britannia to be in fault, and as we agree with them in that conclusion, it is not necessary for us to go at length into that part of the controversy. It is sufficient to say that it appears that the Britannia came so close to Governor's Island that she grazed the bottom, and rendered it necessary...
