MR. JUSTICE BREWER delivered the opinion of the court.

The question presented is as to the validity of an act passed by the legislature of the State of Mississippi on the 2d of March, 1888. That act is as follows:

"SEC. 1. Be it enacted, That all railroads carrying passengers in this State (other than street railroads) shall provide equal, but separate, accommodation for the white and colored races, by providing two or more passenger cars for each passenger...
