MR. JUSTICE WOODS delivered the opinion of the court. He recited the facts as above stated, and continued:

It is plain, and is not disputed by the plaintiffs, that if there had been no proceeding instituted by the United States for the condemnation of the property, and no intervention therein by Morgan, he would have acquired a good title to the premises, by his purchase thereof at the sale made under the decree of the Circuit...
