LIVINGSTON, J. delivered the opinion of the Court as follows:

This is a joint action of debt on a bond dated the 9th of January, 1801, in the penalty of 20,000 dollars.

The condition of the bond is as follows: Whereas the above bound Aquila Giles hath been appointed the marshal in and for the New York district, in pursuance of an act, entitled "an act to establish the judicial Courts of the United States," now...
