Appellant, Leroy Liberda, commenced suit under 42 U.S.C. § 1983, alleging that his constitutional rights were violated by defendants, Timothy Britt, Mark Jackley, Douglas Faesler, and the City of Live Oak, Texas. At the relevant times, Britt was a Live Oak police officer, Jackley was the Chief of Police of Live Oak, and Faesler was the Live Oak City Manager.
