The issue in this interlocutory appeal is whether a Texas court may, consistent with due process, exercise in personam jurisdiction over American Type Culture Collection ("ATCC") in this case. The trial court found that ATCC had sufficient minimum contacts with Texas to justify the exercise of personal jurisdiction.
