[+] andre hughes on HEIRS OF GOZA v. ESTATE OF POTTS
the decision to accept the trial courts verdict and affirming it was the right legal conclusion being as William Bill Potts did void the contractual agreement before he died, and the very fact that he used white out, and wrote the expressed intent to not include the Appellants showed he was mentally capable of excluding the Appellants.
[+] D David Altman on GRAFF v. HAVERHILL NORTH COKE COMPANY
The Court corrected two typos on page 20-21 of the opinion in an Amended Order filed yesterday. The word "not" is missing in two places in the next to last paragraph in "C. Third Cause of Action."

[+] kristina blake on WHITCOMB v. BURWELL
CGM's used in concert with moment-in-time glucose meters make it possible for (especially those on insulin) people to avoid visit to the emergency dept and visits by EMS. This not only saves the patient, but also is money-saving for Medicare. The average US cost for a visit to the ER (without admission) is $17,000. It makes economic sense to cover CGM

[+] Richard Martin on CLAY v. ENSCO OFFSHORE COMPANY
I represent the plaintiff here. This was a cross-motion between the two defendants on the issue of indemnity. By holding that the Daywork Drilling Contract was maritime, despite work being performed at an OSCLA site, state law was not applied (a correct ruling because Plaintiff was a Jones Act seaman injured on a vessel, and was not a fixed platform worker) and the Louisiana Oilfield Indemnity Act didn't apply.

[+] C Fisher on GILLAM v. GUSMAN
Please note this is a "REPORT AND RECOMMENDATION" by the Magistrate Judge for the ultimate disposition of the case, not a final judgment. The District Judge did, however, eventually adopt this REPORT AND RECOMMENDATION and issue and Order dismissing the plaintiff's claims in accordance with it.

It is my understanding that an appeal is not permitted on a remand. Otherwise, I would have challenged Northern District Civil Local Rule 3-9(b) as unconstitutional.
