This lawyer disciplinary proceeding was brought against D. Michael Burke ("Mr. Burke") by the Lawyer Disciplinary Board ("the Board"). The Board found, upon an evidentiary hearing conducted by the Hearing Panel Subcommittee ("HPS") on October 10, 2011, that Mr. Burke had violated the West Virginia Rules of Professional Conduct.1 Upon finding a violation, the HPS proposed in its March 21, 2012, report that Mr. Burke be admonished...
