THORNE, Judge:

¶ 1 Harold Earl Bushman appeals from his convictions on one count of securities fraud, a third degree felony, see Utah Code Ann. §§ 61-1-1,-21 (2006 & Supp.2009), and six counts of attempted securities fraud, each a class A misdemeanor, see id.; Utah Code Ann. §§ 76-4-101 to-102 (2008). Bushman entered a conditional guilty plea to these counts, see generally State v. Sery,
