OPINION

{¶ 1} Defendant-Appellant, the city of Marion ("the City"), appeals the judgment of the Court of Common Pleas of Marion County, which denied its motion for summary judgment and granted Plaintiffs-Appellees', Ohio Council 8 and Local 1158 ("Appellees"), motion for summary judgment.
