We agree with the Supreme Court's denial of the appellants' motion for summary judgment dismissing the complaints in action Nos. 2 and 3 insofar as asserted against them. The appellants made a prima facie showing that the trust and partnership which are at the heart of the causes of action set forth in the complaints were part of a scheme to illegally avoid the payment of taxes.
