The order of the Appellate Term, insofar as appealed from, should be affirmed.

After defendant was found in possession of a switchblade knife at a subway station he was charged, among other things, with attempted criminal possession of a weapon in the fourth degree. Penal Law § 265.00 (4) defines a switchblade knife as "any knife which has a blade which opens automatically by hand pressure applied to a button...
