Ordered that the order is affirmed.

According to the accusatory instrument, at approximately 7:40 a.m. on July 15, 2009, a 12-year-old girl was standing at Riverdale Avenue and Hudson Streets in the City of Yonkers, waiting for a bus to take her to her summer school.
