Appeal from a judgment of the County Court of Broome County (Cawley, J.), rendered August 30, 2011, convicting defendant following a nonjury trial of the crimes of burglary in the second degree, criminal mischief in the fourth degree and petit larceny.

Defendant allegedly broke into a next-door apartment while the two people who resided there were out and stole about 35 of their movie DVDs, which he then sold to a pawn shop for less than $20....
