As the result of his sale of crack cocaine to a confidential informant, defendant was indicted on one count each of criminal possession of a controlled substance in the third degree and criminal sale of a controlled substance in the third degree. Prior to the start of trial, defendant unsuccessfully moved to suppress the evidence of the packet of crack cocaine he sold to the informant on the basis of a break in the chain of custody.
