On October 31, 2003, plaintiff Murat Abail was involved in a moton-vehicle collision with a vehicle operated by the defendant Edward Reyes, while in the employ of Michelle Melendez and owned by the defendant John Brill. The collision took place northbound on the Cross Island Parkway near the Union Turnpike exit, Queens County, New York.
