The State of North Carolina appeals from an order granting a motion filed by Defendant Alejandro Antonio O'Connor seeking to have suppressed certain evidence seized at the time that his vehicle was stopped. On appeal, the State argues that the trial court erred by failing to summarily dismiss Defendant's motion based upon his failure to attach a supporting affidavit as required by N.C.
