In this automobile accident case, Myron Nelson, Jr. and Moncheri Nelson ("Plaintiffs"), were passengers in a vehicle driven by their father, Myron Nelson, Sr. The trial court found after trial that Mr. Nelson was solely at fault for the accident. That finding was not appealed. Allstate Insurance Company ("Allstate"), Mr. Nelson's insurer, settled with the Nelsons under the liability portion of the policy.
