Defendant, Taurino Maldonado, was indicted for driving under the influence of alcohol (DUI) (625 ILCS 5/11-501(a)(2) (West 2006)). Because he had at least five prior convictions of DUI, the offense was charged as a Class X felony under section 11-501(c-16) of the Illinois Vehicle Code (625 ILCS 5/11-501(c-16) (West 2006)).
