In September 2002, the State charged defendant, Ricky King, with five counts of first degree murder (720 ILCS 5/9-1(a)(1), (a)(2) (West 2000)). Later that month, the trial court granted the State's motion to dismiss the criminal charges on the belief defendant had not yet reached 15 years of age at the time of the alleged crime.
