MARTINEZ v. STATE

Case No. 2D17-2888.

251 So.3d 306 (2018)

Lorenzo A. MARTINEZ, Appellant, v. STATE of Florida, Appellee.

District Court of Appeal of Florida, Second District.

Opinion filed July 13, 2018.

Attorney(s) appearing for the Case

Howard L. Dimmig, II , Public Defender and Richard P. Albertine, Jr. , Assistant Public Defender, Bartow, for Appellant.

Pamela Jo Bondi , Attorney General, Tallahassee, and Cornelius C. Demps , Assistant Attorney General, for Appellee.

Lorenzo Martinez appeals his judgment and sentences for: count one, driving with a suspended license and causing death; count two, DUI manslaughter; and count three, failure to remain at the scene of a crash involving death. We agree with Mr. Martinez that his convictions for counts one and two violate Florida's "single homicide rule."
