REPORT AND RECOMMENDATION
1 CONCERNING PLEA OF GUILTY

Today, pursuant to Rule 11 of the Federal Rules of Criminal Procedure and Rule 5 of the Rules for United States Magistrate Judges in the District of Massachusetts, Defendant Luz Gonzalez appeared before me and entered a plea of guilty to Counts I and II of the Superseding Information. After cautioning and examining the Defendant under oath concerning each of the subjects mentioned in Rule 11, I determined that the guilty plea was knowing and voluntary and that the offenses charged are supported by an independent basis in fact establishing each of the essential elements of such offenses. I therefore recommend that the District Judge accept these findings.
In addition, at the plea hearing, this Court made all the factual findings necessary for the acceptance of the plea. However, because the Defendant entered a plea of guilty pursuant to Fed. R. Crim. P. 11(c)(1)(C), I recommend that the District Court defer acceptance of the plea until after the preparation of a presentence report.
