Before the court is defendant Harold Ford's motion to set aside the verdict on count one of the government's two-count indictment. A jury found Ford guilty of distributing five or more grams of cocaine base, in violation of 21 U.S.C. §§ 841(a)(1), (b)(1)(b), on November 10, 2005 (Count 1 of the indictment), but acquitted him of count two, distributing five or more grams of cocaine base in a separate incident on November...
