INTRODUCTION

The Court has before it a motion (and amended motion) for summary judgment filed by defendant Freightliner. The Court heard oral argument on August 21, 2008, and the motions are now at issue. For the reasons expressed below, the Court will grant the original motion for summary judgment, mooting the amended motion.
