UNITED STATES v. DAY

No. 23-2311.

106 F.4th 603 (2024)

UNITED STATES of America, Plaintiff-Appellee, v. Anthony DAY, Defendant-Appellant.

United States Court of Appeals, Seventh Circuit.

Decided July 1, 2024.

Attorney(s) appearing for the Case

Nathaniel Whalen, Attorney, Office of the United States Attorney, Hammond, IN, for Plaintiff-Appellee.

Danielle Hamilton, Attorney, Northwestern University Pritzker School of Law, Appellate Advocacy Center, Chicago, IL, for Defendant-Appellant.

Before St. Eve, Jackson-Akiwumi and Pryor, Circuit Judges.

Anthony Day challenges the district court's denial of a unanimity instruction that would have required jurors to agree on which of two weapons he possessed for purposes of an 18 U.S.C. § 922(g)(1) charge. Because Day possessed the two firearms simultaneously, no such instruction was required. We affirm.
