No. 22-11001.

99 F.4th 775 (2024)

UNITED STATES of America, Plaintiff-Appellee, v. Kyle Lamar WEST, Defendant-Appellant.

United States Court of Appeals, Fifth Circuit.

FILED April 25, 2024.

Attorney(s) appearing for the Case

Amber Michelle Grand , Attorney, Elise Aldendifer (argued), Brian W. McKay, Esq. , Assistant U.S. Attorney, U.S. Attorney's Office, Northern District of Texas, Dallas, TX, for Plaintiff-Appellee.

Taylor Wills Edwards Brown (argued), Federal Public Defender's Office, Northern District of Texas, Fort Worth, TX, David E. Sloan , Assistant Federal Public Defender, Federal Public Defender's Office, Northern District of Texas, Lubbock, TX, James Matthew Wright , Assistant Federal Public Defender, Federal Public Defender's Office, Northern District of Texas, Amarillo, TX, for Defendant-Appellant.

Before Elrod, Willett, and Duncan, Circuit Judges.

Kyle Lamar West appeals the part of his sentence that ordered him to pay $6,000 in restitution. Because the PSR cites inapplicable statutes and the district court failed to conduct a proximate-cause analysis as required by precedent, we VACATE the restitution order and REMAND the case for further proceedings consistent with this opinion.
