(pg. 410-11), delivered a separate opinion concurring only in the judgment. COLE, C.J. (pp. 411-20), delivered a separate opinion concurring in the majority's holding in regards to Anderson and dissenting from the principal opinion, in which MERRITT, MOORE, CLAY, WHITE, STRANCH, and DONALD, JJ., joined.
