(pg. 410), delivered a separate opinion concurring in part and in the judgment, in which GIBBONS, COOK, and LARSEN, JJ., joined. KETHLEDGE, J. (pg. 410-11), delivered a separate opinion concurring only in the judgment. COLE, C.J.
