Joseph Gaglioti was hired by the Levin Group, Inc. ("Levin Group") at the age of 62 to work in the accounting department. Ten months later, he was fired. While initially claiming that Gaglioti was fired because his temporary employment had come to an end, Levin Group also eventually argued that it was Gaglioti's poor performance that resulted in his termination.
