This appeal arises from the retrial of Dorian Ragland on charges that he distributed heroin resulting in death. The first trial ended with the district court1 granting a motion for a mistrial after several days of jury deadlock. After the second trial, a jury found Ragland guilty of distribution of heroin resulting in death, in violation of 21 U.S.C. § 841(a)(1). Ragland was sentenced pursuant to 21 U.S.C. ...
