Before the court is the Defendant's Motion to Dismiss the Complaint. The Plaintiff/Debtor seeks, pursuant to 11 U.S.C. § 362(k)(1), compensatory damages of $10,000.00 and punitive damages of $500,000.00 based on the Defendant's alleged violation of the automatic stay. The Defendant, John Monahan ("Monahan"), is the court appointed Trustee in the case of Marie-Louise Tshiani v. Noel Tshiani,
