PER CURIAM.

In accordance with the Alabama Supreme Court's opinion in Ex parte Pate, [Ms. 1120348, August 30, 2013] 144 So.3d 1258 (Ala.2013), we reverse the trial court's judgment and remand this case to the trial court for proceedings consistent with that opinion.

REVERSED AND REMANDED.
