This Court granted Derek Jermaine Baker's petition for a writ of certiorari to review the Court of Criminal Appeals' unpublished memorandum affirming Baker's conviction and sentence for trafficking in marijuana. See Baker v. State (No. CR-11-0267, December 17, 2012), ___ So.3d ___ (Ala.Crim.App.2012) (table). For the reasons set forth below, we reverse and remand.
