This is an action for refund of taxes paid under protest by plaintiff, McLane Southern, Inc. ("McLane"), a Mississippi-based company, to the Louisiana Department of Revenue ("Department"). Following cross motions for summary judgment filed by the parties, the trial court granted summary judgment filed by the Department, dismissing, with prejudice, McLane's claims against the Department.
