After being charged by grand jury indictment with aggravated rape, aggravated kidnaping, and armed robbery, Melvin Carter was convicted following a bench trial of forcible rape. Carter was adjudicated a third felony offender and received a sentence of 42 years at hard labor which was imposed without the benefit of probation or suspension of sentence. Carter appeals his conviction.1 We affirm the
