THE PEOPLE OF THE STATE OF NEW YORK, Respondent, v. RAHMELL DANIEL, Appellant.

Ordered that the judgment is modified, on the law, by vacating the defendant's conviction of manslaughter in the first degree and the sentence imposed thereon; as so modified, the judgment is affirmed, without prejudice to the People representing any appropriate charge to another grand jury (see People v Beslanovics, 57 N.Y.2d 726, 727 [1982]).
