On December 20, 2006, a Grand Jury sitting in this district issued a two-count indictment charging defendant Edwin Aviles Sierra ("Aviles") with the importation and the possession with intent to distribute of detectable amounts of cocaine (Docket No. 12). On March 6, 2007, on the second day of trial, the Court declared a mistrial upon Aviles' motion, which the United States joined, following a discovery violation...
